Terms of use

Welike Cape Town is a directory of South African businesses ranked by its community, where businesses are vetted by our team, in person and unannounced. It is operated by Innovatech Group (Pty) Ltd (registration number 2017/044479/07), 113 Beach Road, Cape Town, 8001 ("we", "us", "our").

These terms apply whenever you use any Welike Cape Town website. By creating an account, you accept them. Our privacy policy explains how we handle your personal information, and forms part of these terms.

Anyone may browse. To create an account you must be at least 18 years old and able to enter into a binding agreement. Each account belongs to one real person: you may not create more than one, share it, or create one on someone else's behalf.

• Keep your sign-in details secure, and tell us if you think someone else has used your account.
• Voting, reviewing and checking in require a verified phone number. Some features require identity verification. The information you give us to verify yourself must be true and your own.
• A phone number can verify only one account at a time.

The ranking cannot be bought. A business's position comes only from members' votes and our vetting. No payment, advertising or sponsorship changes it. Paid placements are always labelled "Sponsored". See how sponsorship works.

To keep it that way, when you vote or review you agree:

• to base votes and reviews on your own genuine experience;
• not to vote or review a business you own, work for or are paid by, or a direct competitor of one;
• not to offer, accept or arrange anything of value in exchange for a vote or a review, or for removing one;
• not to coordinate votes, or use automation or multiple accounts to influence a ranking.

We may discount, remove or reverse votes and reviews that break these rules, and we may suspend the accounts involved. Reviews must not be defamatory, hateful, obscene or misleading, and must not disclose anyone's private information. Anyone can report a review or listing that breaks these rules.

• Anyone may suggest a business. We decide whether, and how, a listing is published.
• To claim a listing you must be authorised to act for that business. Claims are verified through the contact details we already hold for it. A false claim may be reversed, and the account that made it suspended.
• Owners may respond to reviews and post announcements. Responses must be truthful and courteous, and must not reveal a reviewer's personal information.
• The information on a listing is provided in good faith, but businesses change. Check opening hours, prices and other important details with the business itself.

Perks and deals are offered by the businesses themselves, on the terms shown with each one. Any agreement for goods or services is between you and that business. We are not a party to it, and the business is responsible for honouring the offer.

Advertisers buy labelled space, never a ranking or a vetting outcome. Advertising is prepaid. Prices and the minimum top-up are shown before you pay, and payments are processed by our payment providers. Adverts must be lawful and accurate and must not imitate the community ranking. We may decline or remove any advert. Unused prepaid balances are handled as set out at the time of purchase.

You agree not to:

• break the law, or infringe anyone's rights, using the service;
• create accounts, vote, review, check in, submit a business or claim a listing automatically, or on someone else's behalf;
• scrape the site in a way that ignores robots.txt or burdens the service, or present our data or widgets as anything other than what they are, or remove their attribution;
• probe, overload or try to get around the security or rate limits of the service;
• use a widget or integration key you were not issued.

You keep ownership of the reviews, photos and other content you post. You give us a non-exclusive, royalty-free licence to host, display, reproduce and distribute it on and in connection with the service, including in embeddable widgets that businesses place on their own websites. This licence continues for content that stays public after you delete your account, as our privacy policy explains. You confirm that you have the right to post what you post.

You may delete your account at any time under Settings → Privacy. We may suspend or close an account that breaks these terms, or that we reasonably believe is being used to manipulate the ranking. Where it is appropriate, we will tell you why.

The directory is free for members, and we provide it as it is. We work to keep it accurate and available, but we do not guarantee that it will always be either. To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of the service, or for the goods, services or offers of any business listed on it.

Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008, the Electronic Communications and Transactions Act 25 of 2002, or any other law that cannot be excluded by agreement. Nothing in them limits our liability for gross negligence or wilful misconduct.

These terms are governed by the law of the Republic of South Africa. If something goes wrong, please contact us first, and we will try to resolve it. If we cannot, the South African courts have jurisdiction.

We may update these terms. The effective date at the top of this page shows the current version. If a change materially affects you, we will tell members before it takes effect. If you continue to use your account after that, you accept the updated terms. Questions about these terms can be sent to [email protected].
